Die Frauen und sechs Kinder, die in Prey Speu in Phnom Penh in einer Sozialeinrichtung willkürlich festgehalten wurden, konnten am 18. Januar aus der Einrichtung fliehen. Sie waren während einer friedlichen Protestveranstaltung gegen die Zwangsräumung in Borei Keila und die Inhaftierung von acht AnwohnerInnen festgenommen worden. Andere, die weiterhin protestieren, werden nach wie vor eingeschüchtert.

Die 26 Frauen (ursprünglich war man von 24 ausgegangen) und sechs Kinder waren am 11. Januar in die Sozialeinrichtung gebracht worden. VertreterInnen von Phan Imex, des Unternehmens, das an der gewaltsamen Räumung in Borei Keila beteiligt ist, versuchte die Gruppe einzuschüchtern. Man sagte den Frauen und Kindern, sie werden nur dann freigelassen, wenn sie ein Grundstück in den Umsiedlungsgebieten Tuol Sambo, am Rande von Phnom Penh, oder Srah Po, in der Provinz Kandal, akzeptieren würden. Drei der Frauen wurden am 16. Januar und eine weitere am folgenden Tag, nachdem sie Land in Srah Po angenommen hatten, freigelassen. Den übrigen Frauen und Kindern gelang am 18. Januar die Flucht. Während des Besuchs von zwei oppositionellen Parlamentsmitgliedern konnten Sie über die Zäune klettern, die das Gebäude umschließen.

Die Acht BewohnerInnen, die während der Zwangsräumung am 3. Januar inhaftiert worden waren, befanden sich wegen "Gewaltakten" und der "Behinderung von Staatsbediensteten" in Untersuchungshaft. Einer der Inhaftierten wurde am 18. Januar gegen Kaution aus der Haft entlassen. Die anderen sieben, unter denen sich auch zwei 17-Jährige befinden, wurden ebenfalls am 17. und 18. Februar gegen Kaution freigelassen.

Viele der vertriebenen Familien wurden in eines der Umsiedelungsgebiete gebracht. Sie leben dort unter sehr schlechten Bedingungen, die den internationalen Standards für angemessenes Wohnen keinesfalls entsprechen. Etwa 125 Familien befinden sich trotz der Zerstörung ihrer Häuser noch immer in Phnom Penh. Einige von ihnen protestieren weiter gegen die Zwangsräumung und die fehlenden Unterkünfte. Am 2. Februar wurden etwa 150 Frauen, die sowohl in Borei Keila als auch in Phnom Penh, am Boeung Kak See, gegen die Zwangsräumung protestieren, gewaltsam von der Polizei auseinander getrieben. Sechs der Frauen wurden festgenommen und verbrachten eine Nacht in Haft. Vier der sechs Frauen waren zuvor in der Sozialeinrichtung von Prey Speu festgehalten worden.


HINTERGRUNDINFORMATIONEN - AUF ENGLISCH

On 14 February, a lawyer from the Prey Speu Social Affairs Center submitted a criminal complaint of 'slanderous denunciation' and 'incitement' against human rights defender Mu Sochua, one of the two opposition MPs present when the women and children escaped from the Prey Speu Center. The MPs had visited the centre to talk to the women, find out about their welfare and advise them of their rights. In another recent development, some former Borei Keila residents, represented by lawyers from local human rights groups, have filed a civil lawsuit against Phan Imex, the company involved in the forced eviction. They are calling for Phan Imex to build all of the onsite housing it had contracted to build. The Phan Imex owner has reportedly threatened to counter-sue them. Some of the former Borei Keila residents have also submitted a complaint to Cambodia's Anti-Corruption Unit, alleging that bribes were given to provide non-residents with onsite housing while excluding Borei Keila residents. Borei Keila had been the home for a large poor urban community for many years. The government designated the area as a so-called social land concession for residential development in 2003. Poor homeless families are the primary beneficiaries of social land concessions, according to the 2003 Sub-Decree on Social Land Concessions. The Borei Keila social land concession was intended to be implemented as a land-sharing arrangement between the private developer Phan Imex a government ministry, and residents. The agreement gave the developer 2.6 hectares of the land for commercial development, in exchange for constructing new housing for over 1,700 residents on two hectares of the land. The remainder, consisting of 10 hectares, was to be returned to the ministry concerned. However in April 2010, the company claimed that it could not afford to build all of the housing and received government approval to build only eight of the 10 apartment blocks it had pledged. Left with no prospect of new homes, the 300 families had been protesting against the company and local authority before the forced eviction on 3 January.

- Ich fordere Sie auf, jede Form der Einschüchterung, wie willkürliche Inhaftierung und Gewalt, gegen die vertriebenen Familien und andere Menschen, die eine Lösung für die Gemeinde Borei Keila fordern, zu unterbinden.

- Ich verlange von Ihnen, dass Sie sicherstellen, dass sich das Unternehmen Phan Imex an seine ursprünglichen Pläne hält, Unterkünfte für alle aus der Gemeinde Borei Keila Vertriebenen zu errichten.

- Ich fordere Sie auf, sicherzustellen, dass all die, die von der Zwangsräumung betroffen sind, angemessen entschädigt werden und adäquate Ersatzunterkünfte erhalten, die den internationalen Standards für bewohnbare Unterkünfte entsprechen.

- Leiten Sie bitte eine umfassende und unabhängige Untersuchung der Zwangsräumung in Borei Keila ein. Klären Sie bitte die Frage, aus welchen Gründen die Zwangsräumung vorgenommen worden ist, und gehen Sie den Vorwürfen nach, denen zufolge die Sicherheitskräfte exzessive Gewalt eingesetzt haben.

PLEASE WRITE IMMEDIATELY

- Call on the authorities to halt all forms of intimidation, including arbitrary detention and violence, against the evicted families and others calling for a resolution for the Borei Keila community;

- Demand that they ensure that the Phan Imex company is held to its original undertaking to build housing for all persons evicted from the Borei Keila community.

- Ask them to ensure that all those forcibly evicted are provided with adequate compensation and suitable alternative accomodation that meets international standards for adequate housing.

- Call on them to conduct a full and independent investigation into the Borei Keila forced eviction, examining why the eviction took place and the apparent use of excessive force by security forces.
